Facility and Service Cancellation/Refund Policies

2.3 The Renter shall not, without the prior written approval of the Township and a minimum of 4 weeks’ notice, change or cancel any Rental. Should the notice be less than four weeks the Renter is responsible to find an acceptable replacement Renter or the rental charges will apply.

2.4 The Renter shall give the notice of cancellations to the Municipal Office not to the staff at the Community Centres. Notices left at the Community Centres shall be considered undelivered.

2.5 The Renter acknowledges that the Township shall add interest at a rate of one point two five (1.25%) percent, to every thirty day period during which any sums remain owing to the Township.

2.7 For room and floor rentals, the Renter shall provide a non-refundable, non-transferable payment, in a manner acceptable to the Township, in an amount equal to the last four Rentals booked by the Renter. The Renter acknowledges that this payment is to be used for the last four Rentals booked by the Renter.

2.10 The Renter acknowledges having read this agreement and agrees to be bound by it and the terms and conditions contained herein and hereby warrants and represents that he/she has executed this agreement on behalf of the Renter and sufficient power, authority and capacity to bind the Renter with his/her signature.

4.0 The Township reserves the right to cancel, suspend or change any Rental time for any reason.

4.1 The Township specifically denies that it is making any representation to the Renter that the same Rental time shall be made available to the Renter in any subsequent season or year.

4.2 In the event the Township cancels, suspends or changes any Rental time, the Township shall use its best efforts to provide adequate notice to the Renter and the Township may, at its discretion, allocate an alternative time, or refund the amount of rental fee paid for the lost time to the Renter.

4.3 The Township strongly suggests to all user that sport/activity appropriate safety equipment is used at all times.

4.4 In the event the Township cancels, suspends or changes A Rental time for any reason, the Renter agrees that the Township is not liable in any manner for any type of loss, claim or damages which may flow from such cancellation, suspension or change.

4.5 The Township is not responsible for any lost or damaged property, whether such loss or damage occurs during, prior to, or following a Rental.

4.6 Where this agreement has used the singular it shall be interpreted, where the context requires, to mean the plural and where this agreement has used the plural it shall be interpreted, where the context requires, to mean the singular.

4.7 For the purposes of giving or taking direction concerning this agreement, the Renter may rely on the information received in writing from the Manager of Recreation Facilities who has signed this Agreement on behalf of the Township.

4.8 Any legal notice required pursuant to this agreement shall be sufficiently given if forwarded by prepaid registered mail, sent facsimile or electronically to the parties at the following addresses:

4.9 Any breach of any term or condition of this agreement may result in the Township terminating this agreement without notice to the Renter. In the event the Renter cancels any rental the Township reserves the right to terminate this agreement without penalty to the Township.
